By accessing or using an SM Photography client gallery, you agree to the following Terms of Service. If you do not agree with these terms, please do not access or download any images.

1. Ownership & Copyright

All photographs displayed in SM Photography client galleries remain the intellectual property and copyright of SM Photography (Sophia Morgan), unless otherwise agreed in writing.

No ownership rights are transferred to the client through gallery access or image delivery.

2. Image Usage Licence

Upon delivery, clients are granted a non-exclusive, non-transferable licence to use the images for the purposes agreed upon at the time of booking.

Unless explicitly stated in writing, this licence covers personal use only, including:

  • Personal printing

  • Personal social media sharing (with credit to SM Photography where possible)

Commercial use, advertising, resale, publication, or third-party use is not permitted without a separate written licence agreement.

3. Editing & Alterations

Images supplied by SM Photography are edited to reflect the photographer’s artistic style.

Clients may not:

  • Apply filters

  • Re-edit colours or tones

  • Crop in a way that misrepresents the image

  • Remove watermarks (if applicable)

Any additional editing requests must be discussed and approved by SM Photography.

4. Sharing & Downloading

Client galleries are provided for private viewing and downloading by the client only.

Clients must not:

  • Share gallery links publicly

  • Allow third parties to download images

  • Upload images to stock websites or image libraries

SM Photography is not responsible for misuse once gallery links are shared by the client.

5. Storage & Availability

Client galleries are hosted online for a limited time only.

Unless otherwise stated:

  • Galleries are available for [insert timeframe, e.g. 30–90 days]

  • Clients are responsible for downloading and backing up their images

SM Photography is not liable for loss of images after gallery expiration.

6. Social Media & Portfolio Use

SM Photography reserves the right to use images for:

  • Portfolio display

  • Website content

  • Social media

  • Promotional and marketing purposes

If a client wishes to opt out of this usage, this must be requested in writing prior to image delivery.

7. Image Quality & Colour Variation

Due to differences in screen calibration and printing processes, SM Photography cannot guarantee exact colour consistency across devices or print labs.

Image quality is guaranteed only for files supplied directly by SM Photography.

8. Liability

SM Photography is not liable for:

  • Loss of images due to client failure to download or back up files

  • Misuse of images by third parties

  • Technical issues beyond reasonable control

9. Breach of Terms

Any breach of these Terms of Service may result in:

  • Revocation of image usage rights

  • Requests for image removal

  • Additional licensing fees or legal action where applicable

10. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia.
